As a result,
Satlynx may regulate your usage if we have reason to believe
that your use of the service is adversely affecting our network,
which would subsequently affect the service we provide to our
other Customers.
You are likely to avoid the restrictions imposed by this
policy if your use is typical for the majority of Internet users
and comprises Web surfing and a reasonable amount of data
download. Typical behaviour that may incur restriction is
excessive use of peer-to-peer and supplying large communities of
PCs connected to a single VSAT.
All Customers must agree to comply with this FUP prior to
service commencement. Failure to comply could result in
suspension or termination of your Satlynx service, however
this will not be actioned without consultation with or following
reasonable notification to the Customer.
| 1. Customer Responsibilities |
| 1.1 |
Your use of Satlynx’s services must be
lawful, you may not use the service to: |
| 1.1.1 |
Possess or transmit illegal or
fraudulent material. Anything you look at
on the Internet can be traced back to
your cache files in the web browser of
your pc. It can be a criminal offence to
store illegal material in this way. |
| 1.1.2 |
Send or knowingly receive e-mails
containing illegal or fraudulent
material. |
| 1.1.3 |
Send or procure the sending or
creation of Spam, or any unsolicited
bulk e-mail. |
| 1.1.4 |
Upload any material containing a
virus or any other harmful program. |
| 1.1.5 |
Display the contents of the Satlynx Service in a context not
originated by us. |
| 1.1.6 |
Send data via the Internet which has
forged addresses. |
| 1.1.7 |
Run “port scanning” software which
accesses remote machines or networks. |
| 1.1.8 |
Configure your pc as an open relay
system. |
| 1.1.9 |
Use “bots” to search for newsgroups,
websites or database contents. |
| 1.1.10 |
Drive un-accelerated traffic. |

| 1.2 |
If these guidelines are not followed you
agree to be responsible for all claims including
any costs, whether legal or compensational, and
damages or losses consequent to your actions. |

| 2. Micromagic Rights |

Micromagic will enforce its Fair Usage Policy as
detailed in this document to; |

Protect the integrity of the Service |

Reduce the effects of non-acceptable
activities; To ensure that all Satlynx subscribers have equal and

Any action taken by Satlynx in respect
of its rights will be carried out either in
consultation with or following reasonable
notification to the Customer under these
circumstances. |

| 3. Limitations on the Satlynx
Service |
| 3.1 |
Satlynx endeavour to provide accurate
information however there may be errors or
omissions from which we exclude all liability. |
| 3.2 |
It cannot be guaranteed that the Satlynx service will be uninterrupted or
flawless. |
| 3.3 |
Any dealings you have with other businesses
that you come across using the Satlynx
service is exclusively between you and the
person with whom you are dealing. |
| 3.4 |
It is your responsibility to ensure that
your computer is secure and protected from
viruses and other harmful programs. We accept no
responsibility for any loss of confidential
information from your computer. |
| 3.5 |
Satlynx may provide links to other
websites for which we accept no responsibility
for their content or security. |
| 3.6 |
Satlynx do not claim to provide legal
or professional advice.You are responsible for
any decisions you make based on the information
we provide. |
| 3.7 |
We cannot guarantee that you will be able to
access the Internet at all times, or that you
will always be able to access the Internet at
the speed available to you. |
| 3.8 |
Children should only use the Internet under
parental supervision as Satlynx cannot
guarantee that material unsuitable for children
will not be accessible through the service. |

| 4. Satlynx Liabilities |
| 4.1 |
Liability is excluded from us for failing to
provide our service if due to an event which is
beyond our control. This includes any acts of
God, severe weather, strikes, war, changes in
legislation, accident, equipment or service
failure, including the unavailability of third
party telecommunications services, lines or
other equipment, fire, vandalism or damage. |

We are not liable to you in any way for any
damage or loss (including economic losses). |

for £15 ex VAT. These tokens increase bandwidth
allowance by 1GB (OB) and 0.2GB (IB). |

| The above defined thresholds indicate
the level where speed limits will be applied by Satlynx and do not represent a right or guarantee for
you to transmit these specified data volumes.It follows
that any additional Tokens purchased per service class
will correspond to an increase in the Thresholds,
according to the specification in the service agreement. |
| 6. Restrictions |
| In the following definitions, the 100%
volume figure corresponds to the specified traffic
volume per chosen service class, depending on the number
of the tokens purchased.Threshold volume applies to both
OB Threshold and IB Threshold separately. |

Extreme Limit:
In cases where the threshold is exceeded by >500%
(on the inbound) and >700% (on the outbound) then the
site in question will be suspended during the peak hours
of 08:00 and 20:00 CET. Reinstatement of full service can
only be obtained through either reduction in traffic
below these thresholds or by upgrading to a higher
service class. If a site is in the Extreme Limit for 4
weeks then it will be fully suspended and reactivation
will only be possible by upgrading to a higher service
class. |
Suspension Limit:
In cases where the volume threshold is exceeded by a
significant amount, >1000% in either inbound or
outbound, then the site in question will be suspended
with immediate effect.Reactivation will only be possible
when the site has been upgraded to a higher service
class. |

7. Special Conditions |
| 7.1 |
Satlynx reserves the right to
deliver performance and bandwidth allocation
above the thresholds published in section 6 of
this document. |
| 7.2 |
Satlynx reserves the right to change
these parameters at any time if this appears
necessary to stabilise the performance of the
network. |
| 7.3 |
The day and night profile for Outbound data
transfer (night time from 20:00 to 08:00 CET on
all 7 days / week, no special weekend
treatment). |
| 7.4 |
There will be a complete lifting of all
applied speed restrictions in the Outbound
direction during the night time. |
| 7.5 |
There will be no lifting of applied speed
restrictions in the Inbound direction during the
night time. |
| 7.6 |
Happy hours: Only 50% of the total
transferred data volume will be counted in the
calculation of the restriction thresholds (20:00
to 08:00 CET). |

Volume thresholds will be calculated on a
rolling 30 days time frame. |

For peak hours only, all users with imposed
restrictions in place will also have file
sharing peer-to-peer traffic blocked. |
